Our terms and conditions may be amended and changed in the future. Please make sure you have checked and consented to the terms and conditions when you start your contractual services with Bene Esse Limited. These terms were last updated on Monday 7th December 2020.

For the purpose of this document the term “you” is taken to refer to the contractual entity of an individual with parental responsibility acting on behalf of the child or young person, in addition to the individual entity of the child or young person, with which this policy directly relates to.  

OVERVIEW

1) Mission statement

Our mission is to provide bespoke affordable, accessible, high quality, holistic medical and non-medical consultancy services tailored to the unique need of each individual child and young person.

Through our combined experience working within the public health and education sectors; we understand the challenges in providing an integrated and holistic approach to healthcare.

We are committed to delivering integrated access to healthcare and well-being services for the individual child or young person, their family, and the wider education sector, offering a combination of both medical and non-medical strategies and intervention.

We offer tailored education and training workshops to the private (individual or group), educational and medical sectors covering a wide range of programmes including child development and attachment theory, understanding Neuro-Developmental conditions including ADHD & ASD, practical parenting and behaviour modification.

We recognise the bigger picture in the provision of young peoples’ healthcare; providing an exclusive service that enables us to work collaboratively together to empower the voice of the child and young person in the delivery of their care.

OUR SERVICES

1) Introduction

When you use our services, you commission the services of our members and associates, including medical practitioners who are listed at the General Medical Council (the “GMC”), which is the medical regulatory authority in the UK.

You expressly understand, accept and agree that when providing services the Clinicians (including medical and non-medical professionals) and therapists are independent professionals that are individually responsible for the assessment, diagnostics, advice and recommendations they offer to you. All our practitioners have their own professional indemnity, enhanced DBS certification and professional affiliation to nationally recognised professional regulatory bodies. All our practitioners, have a contractual agreement with Bene Esse Limited to provide services to nationally recognised NICE guidance standards and Diagnostic Standards which adhere to the DSM-V. All our practitioners are peer reviewed and participate in multiprofessional collaborative working as part of the principles of Bene Esse Limited. Our practitioners are independent medical and non-medical practitioners that are individually responsible for the assessment, diagnostics, recommendations and advice they provide you.

In order to provide our clinical services we will need to be provided personal information from you (please see our Privacy Policy). All personal information will be secured securely and confidentially. We are registered with the Information Commissioner’s Office.

As part of our services we may recommend that our clinical reports including our recommendations are shared with other agencies where appropriate including schools, GPs, other medical practitioners. We will not share these reports or information, unless you have authorised for us to do so.

We share personal and clinical information if we have a legal obligation to do so. For example, if there is considered to be a serious risk of harm to a child, yourself or others. Our clinical practice standards will always adhere to and be upheld to the Children’s Act (1989).

2) Children’s Act (1989).

The Children Act 1989 provides the framework for the care and protection of children, relevant to all children and young people up until the age of 18 years. The children Act 2004 places a duty of care on all key agencies to ensure they safeguard and promote the welfare of Children.

Protecting Children from maltreatment, preventing impairment of a child’s health and development, ensuring they have consistent provision of safe and effective care enabling optimum life chances as they enter adulthood.

The children Act 1989 fundamental principles are

  • Professionals must ensure the child’s welfare is paramount.
  • Working in partnership with parents. Consent for intervention or to share information must be sought from parents, unless the safety of the child is at risk, in which case the child’s safety is paramount and disclosure of information without consent may be required.

Health professionals play a key role in contributions to the inter-agency care of children therefore co-operation with other agencies such as Children’s social care, police, education or other health care professionals.

Full regard for a child’s ethnicity, culture, language, religion, gender and/or disability must be given in any decision making or service provision.

In line with our legal obligation, we store reports and personal information on children and young people up until their 25th birthday.

3) Service Provision

Following the use of our services, there may be a request to link you back to your local primary care or NHS services. For the safety of ensuring good client care and for service continuity, we will be required to share your personal information and our reports with your primary care provider.

We are a UK based service provider and subject to UK law. All our services and interaction with you is considered to be taking place within the UK. Some of our services are specifically designed and governed by UK guidelines, diagnostic criteria (for example the DSM-V). Should you wish to use our reports or service recommendations outside of the UK, you should check in your country or region that it is within the law and appropriate to do so.

4) Our Services for Children and Young People.

Children and Young People using our services must follow specific guidelines, set out by Bene Esse Limited.

Children may be able to be seen by a practitioner alone and their confidentiality not to share information provided during consultations respected and upheld, if it is considered in their best interests to do so and they have legal capacity to be able to understand the consultation process and participate in their own decision making.

No Child or Young Person will be seen alone by any practitioner under the age of 12 years and we request that they are accompanied by an individual with legal parental responsibility.

All consultations and services provided by Bene Esse Limited must be arranged with the parents or guardians.

In accordance with the Children’s Act (1989), personal information, data and medical reports can be shared without consent or authorisation if there are significant risks of harm to a child or others. In this situation and if safe to do so, these concerns will be shared with you in advance of sharing confidential information.

5) Accessing Our Services

To access our services or to make a service enquiry via our website, you must be over 18 years.

In order to enter into a contractual agreement with Bene Esse Limited, you represent and warrant that you are at least 18 years of age and possess the legal right, capacity and ability, on your own behalf to accept and agree to our Terms and Conditions.

All fees and charges, without exception, incurred at the time of booking in contractual agreement with Bene Esse Limited are your responsibility as the account holder and must be preauthorised prior to you receiving any of our services. We therefore request a 50% deposit of the total balance on confirmation of your booking and the remaining 50% once the service has been delivered. Any reports, letters, recommendations, advice, education and training manuals/information will be sent directly to you within 14 days of settling the remaining 50% balance.

If the remaining balance is not paid then reports, letters, recommendations, advice and any further agreed service provision will not be delivered by Bene Esse Limited until the unpaid balance is settled. If an unpaid balance continues to be overdue, we will send you reminder overdue invoices and refer the recovery of any costs to our legal team at Markel Law.

Subject to our availability you can choose an appointment time and date that is convenient for you. We deliver appointments Monday – Saturday from Woodlands Family Practice, Woodlands Road, Gillingham, Kent, ME7 2BU and The Pilgrim, 25 London Street, Tyburnia, London, W2 1HH.

Once we have confirmed that we are able to offer the services required, we will email you written confirmation of the appointment. If you do not receive an email within 24 hours of confirming an appointment please contact us directly by ‘phone or email.

Bene Esse Limited will advise you by email as soon as possible, if appointments need to be amended, changed or cancelled.

For virtual consultations and services, you may be asked to show photo ID during a video consultation to enable our practitioners to confirm your identity before engaging within a consultation. ID we are able to accept:

– Current signed passport

– Residence permit issued by the Home Office

– EU or Swiss national identity photo-card

– Valid UK photo-card driving licence

– Valid armed or police forces photographic identity card

– Photographic disabled blue badge

– Citizen card

– Valid student ID with photograph

6) Appointment amendments, cancellation and missed appointments

If you have booked an appointment but due to unforeseen circumstances you are running late, we kindly request that you inform us by telephone given an indication of the estimated delay. We will endeavour to accommodate late arrivals. However, if the late running of the appointment directly impacts upon other scheduled appointments, we may not be able to complete the consultation if there is a delay of more than 15 minutes. This will be discussed directly with you at the time and the appointment rearranged.

If you choose to cancel your appointment, we request that you do so with sufficient notice. If you cancel your appointment within 48 hours’ notice period then we will provide a full refund. If you cancel your appointment with less than 48 hours’ notice a £50 cancellation fee will be taken and we will offer another appointment that is convenient to you. The £50 cancellation fee will go towards covering our costs of last minute cancellations.

You may cancel your appointment any time by emailing or telephoning Bene Esse Limited. We will confirm in writing your cancellation request.

If a Missed Appointment occurs because a Clinician did not attend your appointment in time then we will refund the service fee.

7) Prescribing Medicines

Bene Esse Limited does not currently undertake private provision of medical prescriptions. If following any of our services there is a recommendation for you to be on a treatment plan that involves medication and medication review, we will refer you to your Primary Care, GP services where it may be necessary to refer you to a specialist NHS service provider for continuing care.

8) Termination of our Contractual Agreement

Bene Esse Limited can terminate the contract with you in the following circumstances:

  • If for reasons outside our control, we are unable to provide the Services as detailed in these terms
  • If any fees or charges are not paid when due, and you still do not make payment within fourteen (14) days of us reminding you that payment is due on time
  • You do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Services, for example valid contact details
  • If you breach (as determined by Bene Esse Limited) any of these Terms and Conditions.

Bene Esse Limited will advise you of any termination via the contact email you have provided us with.

9) Refunds and Disruptions

If you think you are due a refund you must contact us as soon as possible providing details of the consultation and a full description in writing of the issue or concern you are raising.

We do not provide refunds where Bene Esse Limited is not at fault, such as in the following circumstances (which is not an exhaustive list but an indication only):

  • If your consultation is disrupted because of your actions, as determined by us exclusively. Where and when appropriate we will provide a refund and at our sole discretion.
  • If you have missed a booked appointment, as determined by us exclusively. In this instance you will be charged the cancellation fee as described above.
  • If a Practitioner fails to attend your appointment, as determined by us exclusively, we will provide a refund
  • If you did not use all available minutes in any appointment that you have started
  • If an alternative service provider, clinician, or practitioner offers a different independent assessment and advice that differs from that provided by the practitioner at Bene Esse Limited.

Neither Bene Esse Limited, nor its practitioners, employees or agents, shall be responsible if the supply of the Services is delayed or prevented by circumstances outside its control. If this happens we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay or failure. If there is a risk of substantial delay you may contact us to cancel your account and/or cancel any booked Services and receive a refund for any Services you have paid for but not received.

10) Limitations

Bene Esse Limited is unable to guarantee the availability of any of our practitioners at a particular time. We will arrange an appointment with a requested practitioner as soon as possible. Each of our practitioners are individual practicing professionals who adhere to the standard of care governed by each of their respective professional regulatory bodies. It is at their own professional and legal discretion to provide services, recommendations, clinical reports and advice to you. You must not tamper with any letters or reports, to do so is illegal and taken seriously and such actions will be referred to our legal team at Markel Law.

There is no guarantee that the content of reports including diagnostic outcomes and further recommendations will represent the content you desire(d), hope(d) for, expect(ed), were informed of or understood or believed they would contain.

At times clinicians may provide different opinions on outcomes (including diagnostics) and recommendations and different clinical opinions on the same condition or set of symptoms. All our neurodevelopmental diagnostic assessments adhere to NICE guidance and DSM-V standards. Provided, our assessments and clinicians’ professional conclusions and recommendations are reasonably upheld, the fact that two clinicians giving differing opinions on the same condition, does not render the services provided by Bene Esse Limited as defective.

11) Service Fees

Bene Esse Limited offers bespoke and individualised service and care plan and additional education and training packages, often requiring a multi-professional approach. Following a triage telephone consultation, Bene Esse Limited will contact you in writing outlining our recommendations and service fees. These fees can be discussed directly with us at any time.

After an initial appointment, you may require further follow up appointments or recommendations to other services provided by Bene Esse Limited. There is no obligation to continue with our recommendations or services offered.

We make it clear in writing the approximate appointment/service time and details of what the appointment will entail, including any pre-requisites such as questionnaires, school reports/observations, educational reports or other information required before the appointment.

All fees and charges are payable by BACS transfer. We request that 50% of the service fee is made on booking and the remaining 50% balance on service completion.

12) Complaints and Disputes

We welcome any feedback on the services we provide. Please contact us at info@beneessehealth.com to provide feedback or complete a service evaluation that we can provide to you on completion of a service.

Please inform us about any complaints you might have as soon as possible so we are able to address and rectify these promptly.

13) Disclaimer

Bene Esse Limited makes no representation or warranty as to the content of any assessment, diagnosis, recommendations or advice provided by any practitioner. Practitioners are independent contractors and not employees of Bene Esse Limited. Any views expressed or advice provided by practitioners are not necessarily endorsed by Bene Esse Limited.

Bene Esse Limited does not offer emergency support. If you find that you are in crisis or are concerned about the welfare about a child or young person, you should contact NHS 111 or attend your local hospital Emergency Services or contact the Emergency Services on 999.

No information or resources found on our website should be relied on as medical advice, professional or otherwise.

Bene Esse Limited makes no warranties or representations as to the accuracy of articles and other material published on our website. We take no responsibility for any consequences relating directly or indirectly to any action or inaction you take based upon such material.

14) Our Branding

You are permitted to use our website in order to enquire about and receive our services. You are not permitted to copy, distribute, or make any business use of Bene Esse Limited.
